Answer:	It is definitely in the way. This is a poor design. I just bend it back as far as I can far enough to allow the USB plug to be seated. I only use these to listen to music so I'm considering cutting it off.

Answer:	Not sure if Skullcandy covers the product. Funny thing, the website says it comes with 90-day warranty. Inside the box there was a piece of paper (regular paper) that reads Skullcandy covers the product for 60 days. So I don't know, hope mine last forever. Brand new comes with a 2-year warranty.
