Answer:	My husband is frequently on work travel and takes a "real" carry-on luggage (older version of this one: http://amzn.com/B008M6ZCF2) w/this backpack strapped to it as his "personal item." He's never been asked to check-in either on US carriers, and the closest call he had was on an international airline which felt he was somewhat abusing that policy. IOW, he's fairly certain the backpack on its own as a carry-on to totally legit. YMMV if it's completely stuffed however, as it becomes rather thick. US carry-on size policy is 22" x 14" x 9" or 56" x 36" x 23" cm while this backpack's dimensions are: 21" x 14" x 10" or 53 x 35 x 25 cm.

If you want fully waterproof you'll need to look for a pack made with fully sealed welded seams for probably at least double the price of this pack. I'm not sure if there are any wheeled packs out there made fully waterproof.
